1. Who these terms bind
This website, foolhardyhorizons.net, is operated by Foolhardy Horizons F.M.B.A, a Forening med begrænset ansvar (F.M.B.A.) registered in Denmark on 15 January 2025 under registration number 45344088, EU VAT number DK45344088, with its registered office at Borups Allé 138, 1. tv, 2000 Frederiksberg, Denmark. In these terms, “we”, “us” and “our” mean that company; “you” means the person or organisation using this website.
By using this website you accept these terms. If you do not accept them, please do not use the site.
2. Use of this website
This site is an informational business website. It presents our games, the publishing services we offer to independent studios, and our company details. It does not sell anything, it does not host game downloads, and it does not provide user accounts.
You agree not to:
- use the site in a way that breaks any applicable law;
- attempt to gain unauthorised access to any part of the site, its server or any connected system;
- submit material through our forms that is unlawful, defamatory, malicious, or that infringes anyone's rights;
- use the forms to send bulk, automated or unsolicited commercial messages;
- scrape, copy or republish substantial parts of the site without our written permission.
We may suspend access to the site, or to the forms, where we reasonably consider it necessary to protect the service or its users.
3. Intellectual property
The text, layout, design, generated artwork, code and structure of this website are owned by us or licensed to us, and are protected by copyright and other intellectual property rights. You may view the site and print or download extracts for your own internal, non-commercial reference. Any other reproduction, distribution or commercial use requires our prior written consent.
Game titles, platform names, storefront names and trade marks referred to on this site belong to their respective owners and are used for identification only. Reference to a storefront or platform does not imply any endorsement, sponsorship or affiliation, and does not imply that a platform holder has approved any title.
4. Enquiries and pitch submissions
This clause matters, so it is written plainly rather than in the usual form.
- Sending a pitch creates no agreement. It does not oblige us to evaluate, respond further, publish, fund or work on your project, and it does not create any partnership, joint venture, agency or employment relationship.
- No confidentiality without an NDA. Unless we have signed a written non-disclosure agreement with you first, material you send us through this website is treated as non-confidential. Please do not send confidential material through the form. If you need an NDA, tick the box on the pitch form and send only a summary; we will arrange one before anything further.
- You keep your rights. Submitting a pitch transfers no intellectual property, licence or other right in your game to us. You confirm that you are entitled to send us what you send.
- Similar ideas. We develop our own titles and review many submissions. We may independently create, or receive from others, concepts that resemble yours. Nothing in these terms restricts us from doing so, provided we do not use your confidential material in breach of a signed NDA or infringe your intellectual property.
- Answers. We aim to acknowledge every submission within five working days and, where we decline, to give a reason. That is a statement of intent, not a contractual guarantee.
5. Publishing agreements
Any publishing relationship is governed by a separate written agreement signed by both parties. Nothing on this website is an offer capable of acceptance, and nothing on it varies the terms of a signed agreement.
Where a publishing agreement provides for us to cover costs relating to a title, we do so from the cooperative's own capital under that commercial agreement, recouped from the revenue of the title on the terms the agreement sets out. For the avoidance of doubt, this is not a loan, a credit facility, a security, a deposit, an equity investment, a collective investment scheme or a public offering of any kind, and we do not provide financial, investment, tax or legal advice.
We give no guarantee of commercial outcome. We do not promise sales volumes, revenue, wishlist numbers, chart positions, storefront featuring, review scores, or approval by any platform holder or ratings board. Where a release depends on a third party's approval, that decision is theirs.
6. Content we do not publish
We do not publish, distribute, market or otherwise support titles that include any of the following, and a submission containing them will be declined:
- Gambling, casino, betting, sweepstakes or any real-money wagering
- Loot boxes, paid random-item mechanics or gambling-style simulations
- Cryptocurrency, tokens, NFTs or blockchain-based in-game economies
- Real-money trading of in-game items and player-to-player marketplaces
- Distribution through unauthorised third-party app stores or APK mirrors
- Adult content, and games designed around addictive or deceptive spending
We do not operate, promote or facilitate gambling in any form. We hold no gambling licence and do not seek one. We do not issue, sell, promote or accept cryptocurrency, tokens or non-fungible tokens, and none of our titles contain blockchain-based economies. We distribute exclusively through official, authorised storefronts.
7. Links to other sites
Where we link to a storefront, a public register or another third-party site, we do so for reference. We do not control those sites, we are not responsible for their content or their privacy practices, and a link is not an endorsement.
8. No warranty
The website is provided “as is”. We take reasonable care that the information on it is accurate and current, and we correct errors when we learn of them, but we do not warrant that the site will be uninterrupted, error-free, or that any particular information is complete. Information about titles in development — including features, platforms and timing — may change.
9. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of business, loss of data or loss of goodwill arising from your use of this website. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded — including any mandatory rights you may have under Danish or EU consumer law.
10. Data protection
How we handle personal data is set out in our Privacy Policy, which forms part of these terms. Cookie information is in section 5 of that policy.
11. Governing law and venue
These terms and any dispute arising out of them or out of your use of this website are governed by Danish law, excluding its conflict-of-laws rules and any provision that would apply the United Nations Convention on Contracts for the International Sale of Goods. The Danish courts have jurisdiction, with the City Court of Frederiksberg as the court of first instance, save where mandatory law gives you the right to bring proceedings elsewhere.
12. Changes to these terms
We may update these terms. The version published on this page at the time you use the site is the version that applies, and the date at the top shows when it last changed.
